Austrian employment law procedures — Kuendigungsanfechtung (§105 ArbVG), Entlassungsanfechtung, ASG proceedings (ASGG), Kuendigungsentschaedigung, claiming overtime/UEL/KV differentials, einvernehmliche Aufloesung negotiation, discrimination claims (GlBG), and draft templates for Kuendigungsanfechtungsklage.

CRITICAL for Anfechtungsfristen! 3. **Who terminated?** — AG-Kuendigung, AN-Kuendigung, berechtigte/unberechtigte Entlassung, berechtigter/unberechtigter Austritt? 4. **Was there a Betriebsrat?** — §105 ArbVG Anfechtung nur moeglich, wenn BR existiert 5. **Did the BR issue a Stellungnahme?** — Zustimmung, Widerspruch, Schweigen? 6. **What is the employment relationship?** — DV-Beginn, Dauer, Gehalt, KollV, All-in, Kuendigungsfrist 7. **What claims are at stake?** — Kuendigungsentschaedigung, Ueberstunden, Urlaubsersatzleistung, KV-Differenz, Abfertigung? 8. **Evidence available?** — Dienstvertrag, Dienstzettel, Gehaltszettel, Zeitaufzeichnungen, E-Mails, Zeugen? …
