# Oesterreich VfGH Verhältnismäßigkeit ## Verfassungsrahmen Das Bundes-Verfassungsgesetz (B-VG) von 1920 / 1929 (Wiederinkrafttretung 1945) verteilt den Grundrechtsschutz auf mehrere Ebenen: - Staatsgrundgesetz 1867 (StGG) über die allgemeinen Rechte der Staatsbuerger, - EMRK seit 1964 im Verfassungsrang (BGBl Nr 59/1964), - moderne Grundrechte (z B Datenschutz DSG, Art 1 Bundesverfassung). Eingriffsbefugnisse stehen unter **Gesetzesvorbehalt** (formelles Bundesgesetz oder Landesgesetz). Prüfung erfolgt über Art 140 B-VG (Normenkontrolle) oder über Erkenntnisbeschwerden. ## Drei Stufen des VfGH Der Verfassungsgerichtshof prüft Eingriffe im **Sachlichkeitsgebot** (Art 7 B-VG / Art 2 StGG) und über die EMRK in einer der deutschen Lehre sehr nahen Form: 1. **Eignung**: das Mittel ist geeignet das oeffentliche Interesse zu erreichen. 2. **Erforderlichkeit**: kein gleich wirksames milderes Mittel. 3. **Adaequanz / Verhältnismäßigkeit im engeren Sinn**: kein ueberlastetes Verhältnis zwischen Eingriff und Zweck.
