Bankacılık uyuşmazlığının kamusal düzenleme katmanı mı yoksa banka-müşteri özel hukuk ilişkisi mi olduğunu ayırmak, uygulanacak kanunu (5411, TBK, TKHK, TTK) ve mahkeme/merci yolunu doğru seçmek gerektiğinde kullanılır.
