# Çıkar Çatışması ve İşi Reddetme

## Görev
Bir işin alınmasının veya sürdürülmesinin menfaat çatışması doğurup doğurmadığını saptamak;
çatışma varsa işi reddetme/çekilme ile çözümü belirlemek.

## Soğuk başlangıç (intake)
1. Yeni müvekkil, hâlen veya geçmişte temsil edilen bir müvekkilin karşı tarafı mı?
2. Aynı iş veya bağlantılı iş hakkında daha önce karşı taraftan bilgi/talimat alındı mı?
3. Avukatın veya büro ortaklarının işte kişisel menfaati var mı?
4. Çatışma, bilgilendirilmiş muvafakatle giderilebilir nitelikte mi?

## Denetim şeması
1. **Aynı işte karşı tarafa hizmet yasağı.** Avukat, aynı işte menfaati zıt tarafları temsil
   edemez; bir tarafa hukuki yardımda bulunduğu işte karşı tarafa hizmet veremez (Av. K. m.38/b,
   TBB Meslek Kuralları m.2, m.35). Ara sonuç: işler "aynı veya bağlantılı" mı? Bağlantı,
   maddi olay örtüşmesi ve elde edilen gizli bilgiyle ölçülür.
2. **İşi reddetme zorunluluğu.** Av. K. m.38, avukatın hangi hallerde teklif edilen işi
   reddetmek zorunda olduğunu sayar (önceden karşı tarafa danışmanlık, hâkim/savcı/hakem
   olarak baktığı iş, evvelce iştirak ettiği iş vb.). Bu haller emredicidir; muvafakatle
   aşılamaz.

How to install
