Die Umgehung funktioniert aber nur, wenn tatsächlich ein Ausnahmetatbestand des § 549 Abs. 2 BGB vorliegt. Liegt keiner vor, gilt das volle Wohnraummietrecht, und der Möblierungszuschlag ist Teil der an § 556d BGB zu messenden Miete.
