Use when ein Markeninhaber einen Verletzer abmahnen will oder eine erhaltene Abmahnung auf Substantiierung und Reaktion zu prüfen ist.

Formal mangelhafte Abmahnungen lösen keine Kostenerstattung aus und können einen Gegenanspruch wegen unberechtigter Schutzrechtsverwarnung auslösen. ## Eingaben - Geschützte Marke (Wort-/Bildmarke, Eintragungsnummer, DPMA / EUIPO) - Verletzungshandlung (Wortlaut, Bilder, Domain, Verwendungsart) - Bekanntheit der Marke (Standard vs. bekannt § 14 Abs. 2 Nr. 3 MarkenG) - Verkehrskreise und Warenähnlichkeit - Vorgeschichte (frühere Abmahnungen / Berechtigungsanfragen) ## Ablauf ### 1. Schutzrechtsstand prüfen - Markeneintrag (Klasse, Gebiet, Eintragsdatum) - Benutzungspflicht § 25 MarkenG (5-Jahres-Frist) - Anhängige Löschungsverfahren? - Geographischer Schutzbereich (DE / EU / WIPO) ### 2.
