Er ordnet das fehlerhafte Verhalten in die etablierte Fehlertypologie ein und adressiert Haftungsbeschränkungen, Mitverschulden und Verjährung. > **⚠️ Aktualität (Stand 2026-07): Das ProdHaftG von 1989 wird vollständig aufgehoben und ersetzt.** Grundlage ist die **Richtlinie (EU) 2024/2853** (in Kraft seit **08.12.2024**, Umsetzungsfrist **09.12.2026**). Deutscher Gesetzgebungsstand: RefE **11.09.2025** → RegE Dezember 2025 (**BT-Drs. 21/4297**) → **1. Lesung im Bundestag am 04.03.2026** → derzeit im **Rechtsausschuss**.
