# /mietrecht:mietpreisbremse ## Zweck Die Mietpreisbremse begrenzt die Miete bei **Wiedervermietung** — nicht die laufende Erhöhung. Sie wirkt nicht automatisch: Der Mieter muss **rügen** (Textform, § 556g Abs. 4 BGB). Für Verträge, die **nach dem 31.03.2020** geschlossen wurden, wirkt eine Rüge, die **binnen 30 Monaten nach Mietbeginn** und während des laufenden Mietverhältnisses zugeht, auf den Mietbeginn zurück; danach nur für die Zukunft (§ 556g Abs. 2 S. 3 BGB). Diese Skill bestimmt die zulässige Miete, prüft die vier Ausnahmetatbestände, ordnet den Vertrag dem richtigen Altrecht/Neurecht zu und formuliert die Rüge. **Rechtsstand: Oktober 2026.** Geltend: Verordnungsermächtigung bis **31.12.2029** (§ 556d Abs. 2 BGB i.d.F. des Gesetzes v. 17.07.2025, BGBl. 2025 I Nr. 163).
