# /mietrecht:mieterhoehung-558-bgb ## Zweck Die Mieterhöhung auf die ortsübliche Vergleichsmiete ist formstreng und zweiseitig: Dasselbe Prüfprogramm entscheidet darüber, ob der Vermieter ein durchsetzbares Verlangen in der Hand hält und ob der Mieter zustimmen muss. Ein formfehlerhaftes Verlangen ist **unwirksam** — die Zustimmungspflicht entsteht nicht, die Überlegungsfrist läuft nicht an, und der Vermieter verliert im Ergebnis mindestens ein Jahr.
