Der Grund ist, dass die Schonfristzahlung nach geltendem Recht nur die fristlose Kündigung beseitigt. Diese Skill prüft die ordentliche Kündigung eigenständig: Erheblichkeit, Verschulden, Form, Frist und die Frage, ob die Berufung auf sie nach vollständiger Zahlung treuwidrig ist. Sie trennt die gefestigte Rechtsprechung vom anhängigen Regierungsentwurf, der diese Rechtsprechung einmal je Mietverhältnis korrigieren würde.
